What is an H1-B Visa Exactly?

An H1-B visa is a non-immigrant visa and is primarily designed for practitioners with an advanced degree. Technically speaking, an H1-B visa is a visa granted by the United States under the Immigration and Nationality Act.

This visa enables companies and employers in the United States to recruit non-US workers in their organizations.

If you’re the recipient of a recently approved H-1B petition, there are several important things you should know about issuing a visa, validity, international travel, and more. Below is a set of actions to be taken by USCIS ‘acceptance of H-1B Visa Application:

  • Approval Notice (I-797) will be sent via slow USPS mail to your solicitor (Approval Notice I-797)

SEND A NOTICE AFTER H1B VISA APPROVAL

H1B Request for a Visa may be accepted with Change or Status or Without Change.

This requirement occurs specifically if, at the time of the H1B Visa demand, the applicants are residing inside the USA or outside the world.

You that fall into either of the following facts, based on your existing visa status, whether you reside in the U.S. or have applied for H-1B from outside the U.S.:

H-1B STATUS CHANGE:

Your H-1B status is active until the most recently released I-94 end-validity period. Your I-94 is at the bottom of your I-797 notice of approval, and/or the CBP I-94 electronic system. The H-1B designation is job-based, and the eligibility expires automatically at the date of termination of work.

If a change of status or extension of stay has been issued, the I-94 will appear at the bottom of the I-797 acceptance note so you will not be forced to fly to the U.S. or qualify for an H-1B visa to “trigger” your H-1B permit.

Unless your H-1B appeal has been accepted for consular notification otherwise at the bottom of the H-1B I-797 clearance letter you will not obtain an I-94 passport. In the U.S. you must apply for a visa stamp. Consulate or embassy abroad until they can ‘trigger’ the H-1B status.

AUTHORIZATION EMPLOYMENT:

Your H-1B status is only valid for the role specified on the H-1B petition, and for the requested duration. After lodging another H-1B petition you cannot consider any other jobs except the supporting company. Please let us know instantly if there are any major shifts in your job with your supporting company during your time of employment. This involves shifts in place of jobs, pay, and duties of employment. Any adjustments may require a petition updated from H-1B.

H-1B ALLOWED IF RESIDING OUTSIDE THE UNITED STATES:

If your H-1B is accepted, you’ll need to have the H1B stamp before you reach America. You should head to the nearest US consulate for H-1B stamping. For your H-1B visa stamping application, consult with the US consulate on the earliest time and date to appear.

However, there are differing regulations for each U.S. consulate. So, it is also wise to test the visa interview date with a consulate first before you book. You needn’t wait until September or October to get H1B Visa stamping.

DEPENDENTS:

The H-4 status of your dependents is valid until their most recently issued I-94 cards end their validity date.

Your spouse and children cannot take up a job in the U.S. without specific permission because they obtain their H-4 status because of temporary worker dependents.

When applying for their H-4 visas, the spouse and any minor children would be asked to submit the following documents:

  • A COPY OF THE AUTHORIZATION NOTICE H-1B
  • Application Type DS-160, Electronic Application of non-immigrant visas
  • Their electronically readable passports (valid for at least six months after your planned stay).
  • Double-colored, passport-style images (each) when they cannot upload photos to their DS-160

They may also be asked to request a copy of your H-1B petition papers, their birth certificates (with approved translation, if applicable), marriage certificates, and copies of your current employer’s financial records, such as pay stubs. H-1B EXTENSIONS

If you need to file an extension of H-1B status beyond the six (6) year limit, be sure to keep evidence of time spent outside the U.S. so that you can recapture this time. Information in your passport can include exit and entry stamps, plane tickets, itineraries, credit card statements, etc.
